Do I need a Spanish lawyer to buy property in Marbella?

Yes. While Spanish law does not strictly require legal representation for property purchase, working with an ICAM-registered Spanish lawyer is strongly advised for foreign buyers. A lawyer reviews title, charges, urbanistic situation, community status, and contracts in your language. At Khello & Partners we handle the entire transaction in Spanish, English, German, or Arabic.

Can a non-resident buy property in Spain?

Yes. Non-residents can purchase Spanish real estate freely. The process requires a Spanish tax identification number (NIE), a Spanish bank account, and registration with the Property Registry after notarisation. Tax obligations include the 10% Transfer Tax (or 21% VAT for new builds) plus notary and registry fees.

What does a real-estate transaction in Spain involve?

Title and charges check (nota simple), urbanistic and community situation review, reserve agreement (arras), private purchase contract, notarial deed (escritura pública), and registration at the Property Registry. Khello & Partners runs this end-to-end, including negotiation with sellers, banks, and notaries.

What is the NIE and how do I get one?

The NIE (Número de Identificación de Extranjero) is the tax ID required for any property purchase, bank account, or contract in Spain. It can be obtained at a Spanish consulate abroad or in Spain at a National Police station with prior appointment. Khello & Partners can manage the process for you under power of attorney.

How is property tax handled for non-resident owners?

Non-resident property owners pay Impuesto sobre la Renta de no Residentes (IRNR) annually (24% on imputed income for non-EU residents, 19% for EU/EEA), plus the IBI (local property tax) and community fees where applicable. We coordinate with external fiscal advisors for full compliance.

What is the typical timeline for a Marbella property purchase?

From offer accepted to keys in hand, a typical Costa del Sol transaction takes 6 to 10 weeks. Faster is possible with prepared documentation (NIE, bank account, financing). Cross-border or off-plan transactions can require longer due to mortgage approval and developer milestones.

Can I inherit Spanish property as a non-resident?

Yes. Spanish succession law applies to property located in Spain regardless of the heir's nationality, with EU Regulation 650/2012 allowing residents to elect their own national law. Inheritance tax (Impuesto de Sucesiones y Donaciones) is regional — Andalusia has favourable rates. We plan and execute international successions across jurisdictions.

Does Khello & Partners work in English, German, or Arabic?

Yes — all four. Founding Partner Amin Khello is a native speaker of Spanish, English, German, and Arabic. The firm drafts contracts, conducts negotiations, and litigates in the client's own language. We serve clients across Europe and the GCC region without translation intermediaries.

Do you handle disputes with developers, sellers, or property communities?

Yes. Litigation is one of our two core practices. We act in civil and commercial proceedings across all phases — reserve-agreement disputes, brokerage cases, construction defects (Ley de Ordenación de la Edificación), eviction proceedings, rent collection, and property-community matters under the Ley de Propiedad Horizontal.

How do you structure investments through a Family Office, SPV, or fund?

We design the appropriate legal vehicle — Spanish SL, SPV, family office, trust, or foundation — calibrated to the client's tax envelope, residency, and inheritance plan. For Private Equity investors we structure for AIFMD and cross-border reporting (DAC6). For UHNWI we plan succession and international mobility alongside the asset purchase.
